Facts About Mediation

Neutral Third Party


A mediator does not decide who is right or wrong or advocate for any particular dispute solution.  Mediators help people or businesses who are struggling to reach an agreement about an issue. Through discussion, facilitated questioning and problem solving, a mediator will help parties reach a consensus.

Mediation is Voluntary


Participation in mediation is completely voluntary and you can choose to stop the process at any time.   Successful mediation is possible, in most situations, when parties are working collaboratively and participating voluntarily.

Confidentiality


What is said in mediation is confidential and cannot be used as evidence in court.

Informality


Mediation is much more informal than the court process, allowing the parties to engage in open communication and creative problem solving.  

Mutual agreement


The mediator helps parties explore their interests, understand other perspectives and generate options for resolution. A final agreement, if there is one, is reached by mutual consent.
